1. Rewards program

1.1 These Terms and Conditions (Terms) set out how FMP Group (Australia) Pty Ltd (FMP) operates its  rewards program (Program). 

1.2 In these Terms, the Participating Brands are FMP, Trico Products Pty Ltd and Ultinon Motion Hong  Kong Co Limited. 

1.3 A person may only participate in the Program if they: 

  • (a) meet the eligibility criteria set out in clause 2; 
    (b) sign up for membership to FMP in accordance with clause 2.2; and 
    (c) that application for membership has been approved by FMP, (Member). 

1.4 FMP makes the Program available at its discretion. FMP may modify, suspend or close the  Program at any time in accordance with clause 9. 

1.5 Members acknowledge and agree that FMP enters into these Terms on its own behalf and as agent  for each other Participating Brand so that they are entitled (as relevant) to the benefit of these Terms to  the same extent as FMP. 

2. Application and eligibility for membership 

2.1 To participate in the Program, Members must hold an account. Accounts are provided by FMP upon  signup, and FMP may reject or accept any account application at its discretion. If FMP accepts an  account application, the date of acceptance is the registration date for that account. 

2.2 Account applications must be submitted to FMP electronically, via the Rewards Plus website  (www.rewardsplus.auto) (Rewards Plus Website). 

2.3 To be eligible for an account, a person must:

  • (a) be an Australian business; and 
  • (b) have a current Australian street address. 

2.4 A person is not eligible to hold an account if they are: 

  • (a) a natural person; 
  • (b) owned by or associated with an employee of any of the Participating Brands;
  • (c) owned by or associated with a relative of an employee of any of the Participating Brands;
  • (d) a direct customer of any of the Participating Brands or a reseller of products of any of the  Participating Brands; or 
  • (e) owned by or associated with a relative of a direct customer of any of the Participating Brands or a  reseller of products of any of the Participating Brands. 
  • (f) a corporate owned workshop. 

2.5 An account application must include the name and contact details of the proposed Member's  authorised person. The authorised person must: 

  • (a) be 18 years or older; and 
    (b) be the owner or controller of the proposed Member, or have their consent to apply for membership,  (Authorised Person). 

3. Membership / Account

3.1 FMP makes accounts available free of charge. 

3.2 Each Member is allowed to sign up for only one account. 

3.3 Upon signing up, both the Member and Authorised Person agree to be bound by the Terms and  consent to the collection of their Personal Information. 

3.4 A Member must notify FMP, via the Rewards Plus Website, as soon as practicable, and in any  event, within 7 days after any change in the Member's or the Authorised Person's details.

3.5 It is the Member's responsibility to keep access to its account secure. FMP will not be liable for the  unauthorised use of a Member's account or Points.

3.6 A Member may close their account at any time via the Rewards Plus Website or by email to  support@rewardsplus.auto. Upon closure of the account, any Points remaining in the account will  expire on the date of closure. 

3.7 Accounts are personal to Members, and are not transferable. 

3.8 A Member may, in a single transaction, utilise only one promotional code assigned to its account  (Promo Code). Once a valid Promo Code is applied to a Member's profile, it cannot be replaced or  combined with any other Promo Code. 

4. Member obligations and responsibilities

4.1 In participating in the Program or using their account, a Member must: 

  • (a) not breach the Terms; 
  • (b) not sell or transfer their account, or Points, or purport to do so; 
  • (c) not engage in fraud or illegal activities; 
  • (d) notify FMP as soon as possible in the event of unauthorised use of their account; and 
  • (e) set a password for their account, and keep it confidential. 

5. Points

5.1 Members may earn Rewards Points (Points) by purchasing any product of any of the Participating  Brands advertised or mentioned on the Rewards Plus Website as being included in the Program  (Eligible Products). 

5.2 The number of Points to be earned on purchasing an Eligible Product are as specified on the  Rewards Plus Website. 

5.3 To claim Points, Members must scan and submit an invoice, in relation to the purchase of one or  more Eligible Product(s), on the Rewardsplus Website. Only invoices evidencing Eligible Product  purchases made: 

  • (a) on or after; or 
  • (b) within 7 days before, 

the registration date for that account under clause 2.1, can earn Points 

5.4 Points may be claimed only once in relation to each unit of an Eligible Product. Points may not be  claimed from a barcode applied to an Eligible Product which that Member has 

not purchased. 

5.5 The Point value associated with each Eligible Product is set by FMP (after conferring with the other  Participating Brands, as required), and may be modified by FMP at its discretion (after conferring with  the other Participating Brands, as required). 

5.6 Points claimed in respect of an Eligible Product which is subsequently returned by a Member will be  invalidated. 

5.7 If the number of Points allocated to an Eligible Product under clause 5.2 are manifestly in error, then  FMP may vary down the Points allocated and consequently may modify a Member's Points' balance  accordingly. . 

5.8 FMP has the discretion to amend a Member's Points' balance if FMP reasonably suspects any fraud  or theft has occurred in relation to that Member's accrual of Points, or otherwise amend a Member's  Points' balance at its discretion, if FMP has reasonable belief or suspicion that a Member has breached  the Terms. 

5.9 If FMP reasonably believes or suspects that a Member holds more than one account, FMP may at  its discretion invalidate all Points accrued by those additional accounts and terminate all of the  Member's additional accounts immediately without notice. 

5.10 Points do not give a Member any vested rights. 

5.11 Points have no cash value. Points may not be sold, bartered, transferred, traded, or combined with  another Member's Points. 

5.12 Points will expire 24 months after the date on which they were claimed.

6. Redeeming rewards

6.1 Once a Member has claimed Points, they may be used to redeem rewards only if the Member's  Points balance has met a minimum threshold of 1000 Points and meets the Point value FMP has  assigned to the reward that the Member requests to redeem. 

6.2 Members can only make a request for redemption via the Rewards Plus Website. 6.3 The number of Points required to redeem a reward is determined by FMP, at its discretion (after  conferring with the other Participating Brands, as required), and may be changed by FMP from time to  time without notice. 

6.4 None of the Participating Brands make any warranty or representation about the underlying value of  the rewards. 

6.5 If a Member submits a redemption request for a reward which is no longer available, FMP may,  acting reasonably, satisfy that Member's request by providing the Member with a comparable reward of  a similar type. 

6.6 None of the Participating Brands will be responsible or liable if a reward cannot be redeemed by a  Member on the Rewards Plus Website due to any technical issue, including without limitation, the  failure of software or due to a hardware malfunction. 

6.7 FMP may dispute the validity of a claim for a reward, or refuse to fulfil a Member's reward claim, if  FMP reasonably believes or suspects that the claim is fraudulent. 

6.8 Once Points are used to redeem a reward, those Points cannot be reinstated to the Member's  account. 

6.9 Merchandise rewards will only be delivered to the Authorised Person's Australian street address.  Rewards will not be delivered to a PO Box address. 

7. Rewards

7.1 Program rewards will be selected by FMP (after conferring with the other Participating Brands at its discretion) and listed on the Rewards Plus Website. 

7.2 The type and value of rewards available in the Program will vary from time to time. None of the  Participating Brands make any warranty about the availability of a specific reward. Members should not  rely upon the continuing availability of any particular type or value of reward, or assume that the Points  value attributed to a particular reward will not be modified. 

7.3 Rewards are subject to these Terms, including Terms relating to the validity of and expiry of the  reward. It is the Authorised Person's responsibility to familiarise themselves with these Terms. 

7.4 Rewards are personal to the relevant Member's Authorised Person, and may not be transferred or  exchanged for money. Rewards will not be replaced if lost, stolen, damaged, or destroyed, and  merchandise rewards will not be substituted, unless they are delivered damaged and such damage is  notified in writing to FMP within 5 business days of the reward being delivered under clause 6.9

7.5  Rewards may be subject to personal income or other tax, which will be the entire responsibility of the  Member and the Authorised Person. Members and Authorised Persons may wish to consult their tax  adviser to ensure that they understand the tax implications, if any, of redeeming rewards through the  Program. 

8. Spin and Win

A total of fifty-one (51) predetermined winning moments shall be randomly allocated each calendar  month throughout the duration of the twelve (12) month promotional period. Each calendar month, the  following prize structure shall apply: 

  • One (1) prize of 500 points; 
  • Five (5) prizes of 300 points each; 
  • Ten (10) prizes of 200 points each; 
  • Fifteen (15) prizes of 150 points each; 
  • Twenty (20) prizes of 100 points each. 

All prizes are awarded to the successful claimant and are redeemable by the principal member only.

Eligibility for Participation

Participants shall become eligible to receive one (1) spin upon approved claim. Thereafter, participants  will earn one (1) additional spin for every twenty-five (25) eligible claims submitted, up to a maximum of  six (6) spins per calendar month. Spin entitlements reset on the first (1st) day of each calendar month. Those Selected Winning Times will be selected by a computerised random system. The first valid entry  received on or after a Selected Winning Time will win an instant win prize (subject to verification). A  maximum of one (1) instant win prize will be awarded in respect of each Selected Winning Time. 

9. Digital Prepaid Gift Card

9.1 Authorised Persons may log on to a Member's account and following the relevant instructions on  the Rewards Plus Website, may elect following attainment of 1000 points to have that Member's Points  balance outstanding at that time converted to a digital prepaid gift card (Gift Card). The conversion rate  from points to prepaid value will be as determined or varied by FMP from time to time. A Gift Card will  be delivered to an email address nominated by the relevant Authorised Person, which may be the email  address associated with that Member's account. .A Gift Card cannot be suspended or cancelled  following issuance, and cannot be redeemed to purchase products from FMP or any other Participating  Brand, unless FMP or such Participating Brand is listed as an eligible merchant with respect to the Gift  Card. 

9.2 The Gift Card is issued by Heritage and People’s Choice Limited trading as Heritage Bank ABN 11  087 651 125 (Heritage) pursuant to a licence from Visa Worldwide PTE Ltd. Blackhawk Network  Australia Pty. Ltd. ACN 123 251 703 is Heritage’s program manager for the Gift Card. The terms and  conditions for usage and redemption of the Gift Card are accessible on the Gift Card and also on the  following link: Terms & Conditions - Digital Prepaid Gift Card. Card. Balance in, transaction history for  and important notices about a Member's Gift Card are available, free of charge, at  www.myprepaidcentre.com.au or can be accessed by calling 1800 778 619. 

9.3 Information about the balance remaining in a Gift Card may also be obtained at any time by a  Member by logging into their digital wallet which can be downloaded from the Rewards Plus Website.

9.4 Individual and Group branded Gift Cards may be redeemed in-store or online, depending on the  relevant retailer's terms and conditions. Members must review all applicable retailers’ terms and  conditions prior to the selection of a Gift Card. Gift card redemptions are final and amounts once spent  from a Gift Card cannot be returned to it. 

9.5 A Gift Card is not a credit card; it is a prepaid card that can be used to pay for transactions up to the  dollar amount available in Gift Card, representing that Member's Point balance as converted under  clause 9.1. Members should keep themselves informed of the Gift Card balance at all times. Any  attempts to make purchases exceeding the Gift Card balance at the time of purchase will be denied.  The relevant Member may be permitted to pay for the difference with cash, cheque or a credit/debit  card, depending on the relevant individual merchant. 

9.6. Members are responsible for all purchases made with their Gift Card, including any use by persons  other than the Member. 

9.7 Any item purchased using a Gift Card, which a Member may wish to return or exchange, is subject  to the return and/or exchange policy of the individual merchant from which the purchase was made.

9.8 The expiration date of a Gift Card is shown on the relevant Gift Card. If a Member does not spend  the balance in a Gift Card before it expires, any unused funds will be lost and cannot be claimed as  cash. 

9.9 Any ancillary costs associated with redeeming a Gift Card are to be borne by the relevant Member.

9.10 All taxes on reward dollars provided through a Gift Card are the sole responsibility of the Member holding the Gift Card. Further, any tax liability arising from or from using a  Gift Card is the responsibility of the relevant Member. 

10. Revoking Points and closure of accounts for Member breach

10.1 FMP may, at its discretion, revoke a Member's Points or close a Member's account if FMP, acting  reasonably, suspects or believes that the Member has materially breached the Terms.

11. Suspension or closure of the Program

11.1 FMP makes no warranty as to the continuing availability of the Program. FMP may cancel,  suspend or close the Program at its discretion. If FMP does cancel, suspend or close the Program, it  will provide Members with 90 days' notice of the cancellation, suspension or closure. Members may  redeem rewards during the notice period. Any Points not redeemed at the end of the notice period will  be forfeited. 

12. Privacy

12.1 In these Terms, Personal Information has the meaning given to that term in the Privacy Act 1988  (Cth) as amended from time to time. 

12.2 When submitting an application for an account, applicants are asked to agree to be bound by the  terms FMP's Privacy Policy, available at https://www.bendix.com.au/privacy-policy (FMP's Privacy  Policy). Upon FMP's acceptance of an application, Members and Authorised Persons will be bound by  the terms of FMP's Privacy Policy. 

12.3 Members and Authorised Persons acknowledge and agree that Personal Information about a  Member and/or an Authorised Person and sales data (which may or may not include Personal  Information) that is held by FMP may be disclosed by FMP to another Participating Brand and to the  Program provider Elevate Loyalty Pty Ltd (ACN 664 184 598) (Elevate) and Elevate's subcontractors  and, subject to clause 12.9, to any third party. 

12. 4 Members and Authorised Persons agree and acknowledge that Personal Information about a  Member or an Authorised Person that is held by a Participating Brand (not being FMP) may be  managed differently by that Participating Brand in accordance with that Participating Brand's privacy  policy. 

12.5 By participating in the Program, Members and Authorised Persons consent to receiving direct  marketing communications from FMP and/or each other Participating Brand, which may be in the form  of in-App notifications, emails, telephone marketing, SMS messages, and other digital messaging, so  that FMP and/or each other Participating Brand may notify the Member and the Authorised Person of  news, offers, promotions, and product updates which FMP believes may be of interest to the Member  and the Authorised Person. 

12.6 Members and Authorised Persons may opt out of receiving direct marketing material from FMP or  other Participating Brands at any time by using the unsubscribe or opt-out facility provided in the  relevant communication (including replying STOP to an SMS where applicable), or by logging into their  account and modifying the relevant settings. 

12.7 FMP and the Participating Brands will send commercial electronic messages in accordance with  the Spam Act 2003 (Cth), including requirements relating to consent, identification of the sender and  the provision of a functional unsubscribe facility. Unsubscribe requests will be actioned in accordance  with applicable law. 

12.8 Members and Authorised Persons may request access to and/or correction of their Personal  Information (held by FMP, and Elevate and Elevate's subcontractors or another Participating Brand) by logging into their Account and making the relevant request in the "Members'  Area". 

12.9 Before FMP discloses Personal Information to any third party (other than where such disclosure is  to another Participating Brand and/or Elevate) FMP will, where possible, take steps to de-identify that  Personal Information before it is disclosed, provided that such de-identification is not contrary to law.

13. Liability

13.1 Certain laws may imply terms, warranties and guarantees into the Terms, the exclusion of which  would contravene those laws or render void the clause containing that exclusion. None of the  Participating Brands intend to exclude, restrict or modify the application of those laws in this clause 13.

13.2 To the extent permitted by law, each Participating Brand excludes all liability arising from or in  connection with the Terms or the Program. If a Participating Brand is not permitted to exclude its  liability, then each Participating Brand's liability to a Member or an Authorised Person is limited to $100. 

14. General

14.1 In these terms, unless the contrary intention appears:

  • (a) the singular includes the plural and vice versa; 
  • (b) '$' means Australian dollars; and 
  • (c) a reference to 'include' or 'including' means 'including but not limited to'. 

14.2 The Terms are governed by the laws of Victoria, Australia. FMP, the Member, and the Authorised  Person submit to the non-exclusive jurisdiction of the Courts of that State. 

14.3 If part or all of a clause of the Terms is illegal, void or unenforceable, then it will be severed from  and does not affect the validity of the rest of the Terms. 

14.4 A failure to exercise or a delay in exercising a right or power provided under these Terms does not  preclude or operate as a waiver of the exercise or further exercise of that or any other right or power.

14.5 FMP may update or modify the Terms at any time at its discretion. Updated or modified terms will  be published on the FMP's website: www.bendix.com.au. If any update or modification to the Terms is  likely (in FMP's reasonable opinion) to materially affect a Member's or Authorised Person's rights, FMP  will provide them with prior notice of the update or modification.
